TF High Court case to be heard next month

The High Court case questioning the validity of the receivers for the TF Hotel and Theatre and the Harlequin Hotel, both in Castlebar, is to be heard next month.
Justice Peter Kelly of the Commercial High Court this week confirmed the date of November 7 for the case with three days set aside for the hearing.
Diorama Ltd, the company behind the TF Hotel and Theatre and adjoining Harlequin Hotel, is seeking to remove bank-appointed receivers from the Castlebar hotels on two grounds. It is arguing that the deed of appointment of the receiver is invalid, and that there was a misappropriation of substantial deposit funds by Bank of Scotland in 2010.
The two hotels were placed in receivership last May by Bank of Scotland. However, Pat Jennings, whose family has owned the TF since the 1950s, is appealing the receivership to the High Court.
On July 21, Ms Justice Mary Finlay-Geoghegan ruled that there was a case to answer on the basis of Mr Jennings’s application. The date of November 7 was provisionally set on September 24 last and confirmed this week.
At last week’s sitting of Castlebar District Court, Judge Mary Devins again adjourned any issues pertaining to the licence and bar exemptions until after the High Court deals with the matter. No bar exemptions will be granted to the TF Hotel and Theatre in the interim. That issue is due back before Castlebar District Court on December 5.
