Westport family dispute in court again

A LONG-RUNNING family dispute that has left a Westport brother and sister estranged and embroiled in a series of legal battles ended up in the courts again last week. Developer Roger McGreal claimed at last week’s sitting of Westport Circuit Civil Court, held in Castlebar, that his brother-in-law and sister, Kieran and Ann Lynn, had trespassed on a piece of land owned by him at Carrabawn, Westport.
He also claimed that he had not received responses to a series of communications to the defendants about the matter.
Counsel for the Lynns, Eoin Garavan said: “We do not know what this case is about, but we are quite happy to concede this strip of land to him. Mr McGreal has never given us a map defining what he is claiming, but my clients will give him the land anyway if it gets him off our backs.”
Mr Garavan also argued that he had furnished Mr McGreal with ‘everything he had asked for that was relevant’.
Judge Rory McCabe noted the fact that the defendants had now abandoned their claim to the land.
The court heard that the relevant land was a strip five to six metres in width and 100 metres long that had been planted by Mr McGreal back in 1986. The complainant sought damages and requested that chain fencing be removed as well as a boundary wall.
The judge asked Mr McGreal to assess damages and adjourned the case until the circuit hearing of the last week of July.
