Sentencing adjourned for 12 months after the court heard defendant’s infant child had died during the summer
A MAN who was arrested for trespassing in a transport depot with five plastic drums and a syphoning pump had his sentencing adjourned for 12 months after the court heard his infant child died during the summer.
Martin Ward (27) of 40 Gleann Ard, Ballaghaderreen, was arrested on August 7 last after he was observed in the Tooreen Transport Ltd yard at Crossbeg, Tooreen, Ballyhaunis.
Garda David Brandley explained he was on patrol at 11.40pm when he saw a man and a Ford Focus in the yard. Garda Brandley spoke to the defendant, who said he was going to the toilet, but when his car was searched five empty plastic drums were found, and he was arrested on suspicion of trespassing.
When Mr Ward was interviewed, he also admitted he had a syphoning pump concealed in the boot of the car.
Under questioning from Mr Alan Gannon, solicitor for the defendant, Garda Brandley said that the defendant ‘made it easy for me’ to find the pump by telling him about it.
Mr Gannon said his client was a father of three, and that his two-and-a-half-month-old child had died in June. He added that the what occurred at Tooreen Transport’s yard was out of character. Mr Gannon said his head was not in a right place, and he asked Judge Mary Devins to be as lenient as possible.
Judge Devins said she would adjourn sentencing for 12 months, until September 6, 2016.
