Brothers fined for fishing during closed season
TWO brothers who were caught fishing during the closed season in Cong were both fined and ordered to pay costs at last Friday’s sitting of Castlebar District Court.
Michael McDonagh of 56 An Sruthan, Castlebar and his brother Jimmy McDonagh of 11 The Grove, Castlebar were detected fishing in the Cong canal on February 20, 2012 during the closed season.
The court heard that the two men had a rod and a net and when they were approached by Fishery Officers they gave false names. Jimmy McDonagh gave his name as Jonathon McDonagh while Michael McDonagh gave his name as Martin McDonagh.
Their true identities were later discovered and Michael McDonagh was charged with giving a false name while Jimmy McDonagh was charged with fishing during the closed season. Both men had previous convictions for illegal fishing in the past.
Mr Gary Mulchrone, solicitor for the two brothers said they were keen fishermen and fished as a sport and released their catch rather than taking it.
The penalties carried a fine of €640 for not giving a correct name while fishing during the closed season carried a fine of €220. When asked by Judge Mary Devins for the reason behind the fine for giving a false name being three time more than fishing in the closed season, it was explained that it was a by-law for that river.
Judge Devins commented that this was ‘interesting’ before fining Michael McDonagh €150 and ordering him to pay €300 costs and fined Jimmy McDonagh €200 and ordered him to pay the same amount of costs.
